On 10 November 2009 the High Court of Australia handed down judgment in relation to claims brought by Mr Moubarak and Mr Bou Najem against Adeels Palace Pty Limited. The case deals with obligations and duties owed by a licensed premises to prevent injury to its patrons, from the conduct of a rogue patron. More specifically, the High Court judgment deals with the duty of care and causation provisions of the Civil Liability Act 2002 (NSW), and provides some important guidance upon the interpretation and application of those provisions.
