Liability by two or more tortfeasors for similar losses in respect of the same transaction does not mean that they are necessarily concurrent wrongdoers for the purposes of Part 4 of the Civil Liability Act 2002. So held the New South Wales Court of Appeal in Mitchell Morgan Nominees Pty Limited & Anor v Vella & Ors [2011] NSWCA 390.
